Rulemaking

The N.C. Department of Military and Veterans Affairs (DMVA) adopts rules to implement or make specific a law applicable to DMVA.  This rulemaking page contains information and links related to current rulemaking activities by DMVA, including but not limited to, published notices, explanation of the proposed rule, reason for the proposed rule, and any fiscal note that has been prepared for the proposed rule.  If there is nothing listed, it means there is no current rulemaking underway within the DMVA.

Pursuant to NCGS 150B-21.2, DMVA will post proposed rules to Department Rules for public review and comment. DMVA will accept comments on the text of a proposed rule and fiscal note (if any) that has been prepared in connection with the proposed rule for at least 60 days after the text is published or until the date of any public hearing held on the proposed rule, whichever is longer. DMVA will consider fully all written and oral comments received.  If an objection is not resolved prior to the adoption of the rule, a person may also submit written objections to the Rules Review Commission. If the Rules Review Commission receives written and signed objections in accordance with G.S. 150B-21.3(b2) from 10 or more persons clearly requesting review by the legislature and the Rules Review Commission approves the rule, the rule will become effective as provided in G.S. 150B-21.3(b1). The Rules Review Commission will receive written objections until 5:00 p.m. on the day following the day the Rules Review Commission approves the rule. The Rules Review Commission will receive those objections by mail, delivery service, hand delivery, or facsimile transmission.

The DMVA maintains a list of interested persons who would like to receive notice of all rule proposals.  If you are interested in being on the Department's registered mailing list, email Theresa.Wright-Bryant@milvets.nc.gov with “Request to Receive Notice” in the subject.
